The EEOC Religious Discrimination Lawsuit Against the United Airlines
According to the case, United Airlines employees complained about religious discrimination in the airline(“United Airlines to pay $305,000,†2022).One of the requirements of the United HIMS program is that pilots who need to be given a medical certificate from the federal aviation administration must undergo Alcohol Anonymous (AA) regularly.Following this requirement, A Buddhist pilot found it wrong to attend alcohol anonymously because his religion does not allow him to do so. The pilot decided to participate in a Buddhism-based peer support group instead. United Airlines failed to consider the Buddhist pilot’s religious beliefs. They denied him the medical certificate, a mandatory requirement for each pilot to fly.
Based on the judgement of the case, United Airlines was forced to pay the pilot a sum of $350,000 for the damages caused to the pilot. In addition, the airline was to bring back the Buddhist pilot into the HIM program and ensure he attended the peer recovery program.Furthermore, the airline was supposed to consider the religious objections of pilots seeking to go through the HIM program.
According to the EEOC’s argument, the airline committed an offence by failing to adhere to the civil Act of 1964 Title VII. Title VII of the Civil Rights Act stipulates that employers must consider the employee’s religious beliefs as long as they do not affect the regular operation of the business. Employers should discriminate against their employees based on their religion.
Admittedly, United airlines managers could have easily avoided this lawsuit. First, they could have allowed the Buddhist pilot to attend the Buddhism peer support group and granted him the medical corticate. In addition, the airline could have settled the matter outside the court before escalating. To avoid this, managers need to ensure they consider their employees’ religious beliefs.
